Question from a Reader: My son is on probation. He’s on arraignment for two charges and wants to leave country and never come back. Is this possible? His probation is for a disorderly conduct charge. He just got a ticket for lying to police, and trespassing. He wants to go to Israel and never return. I am a wreck. My first question: Can he get out of the US? And two: Will he be able to work in Israel?
Counsellor Bailey’s answer: Ignoring probation will result in a Violation of Parole (VOP) and he is then facing the possibility of being resentenced on the VOP, up to the maximum sentence he was facing for the original charge. A conviction on the new charges will probably have the same conclusion. These charges will result in a bench warrant if he does not show up in Court. Have him consult with an experienced New Jersey criminal defense attorney to see how to mitigate these two issues BEFORE his scheduled Court date after which he can move on with his life.
