When you are on Probation or Parole, there are parole and probation restrictions. For starters, any use of alcohol or illegal drugs is a basis to violate. In New Jersey, when you are violated from Probation, the Judge can extend the probation, can impose additional probation restrictions, or can re-sentence you up to the maximum you were facing for the charges you were put onto Probation in the first place. When you are violated from Parole, the decision of whether you are going to be returned to prison and for how long rests with the Parole Board. Either way, please be aware that using illegal drugs after being placed into a release program will raise the question of whether you should be re-incarcerated. How you answer how the dirty test results happened will determine whether you are. If you have been in violation knowingly or by mistake, or perhaps unwittingly through no fault of your own, and need the presence and strategy of a criminal defense attorney before the judge or Parole Board, contact my office by phone for a free initial consult to discuss the merits of your case, and your options and prospects moving forward.
