Newark, NJ Pre-Trial Intervention Attorney
The PTI program is an alternative disposition that is available to certain first-time offenders charged with a crime in the Superior Court. If you are accepted to participate in a pre-trial intervention program, in most cases you do not enter a guilty plea, but participate in a supervisory program similar to probation. Once you complete the program, the charge is dismissed and you are able to apply to have your record expunged.
If you are charged with a crime in NJ, contact Howard Bailey at 973-982-1200 to discuss whether you will be able to take advantage of this program.
Benefits of PTI Participation
In many cases, you are eligible to take advantage of this program. You are not required to admit any guilt, you do not get incarcerated, and you get to apply for an expungement of your criminal record shortly after you are discharged from participation. If you complete every condition of PTI, you can attempt to get discharged from the program earlier than the initial diversion period you were given. This in turn would allow you to apply earlier to get your criminal record expunged.
Defending a Termination from Pre-Trial Intervention
This program is a one-time opportunity to divert your case. You are only able to get a diversionary treatment one time. If you do not complete the conditions of your participation, you will be in violation of the program and your case will be brought back to the Judge. If the Judge agrees with the alleged violation, your charge will be re-activated, and your PTI participation will be terminated. Once your case is re-activated, you will have to either fight the charge or plead guilty to it. If you are being removed from PTI participation call Howard Bailey at 973-982-1200 for a free consultation about what your options are.
